These sales conditions govern the sale of products marketed by Trem srl through the E-commerce site www.ibath.it

All purchases made through the www.ibath.it site will be governed by these sales conditions (under the Italian laws and in particular D.Lgs. [Legislative Decree] 70/2003 on e-commerce and D.Lgs. 206/2005 on the rules governing distance contracts).
Any changes or new sales conditions will be timely notified to the Customer.

More details on the contract for the sale of the products

The Customer declares and guarantees that s/he is of age (in case of individuals) and that the personal data provided when registering on this site are correct and accurate. The Customer agrees to timely report any change in such data, and to verify that the e-mail address provided upon the registration still works properly.

The credentials to access the personal area of the website are personal and not to be given to third parties. By sending the Order electronically, the Customer submits a firm offer to buy the products selected in the Cart, with an express request for performance even without a prior acceptance. It is then the Seller’s decision whether to accept the offer or not, or to accept it for part of the indicated quantity. Notice of the decision will be given to the email address indicated upon the registration.

By confirming the order as required, the Customer declares that s/he has read the indications provided during the purchase procedure and accepts the conditions reported below.

An accompanying invoice will be issued for each purchase. The documents will be directly included in the shipment.

Completion of the purchase on ibath

The Customer may only buy products appearing on the site www.ibath.it at the time of the order as described in the relevant information sheets. The images on the site are shown to facilitate the selection of the model by the user and might not exactly correspond to the product delivered.

The availability of the products is generally indicated on the site and updated as often as possible.

This should ensure reliable information, but it may happen that a product indicated as available at the time of the Order is not included in the Order.

You will be timely informed of any missing item and you may decide to receive a partial order, wait for the arrival of the product or cancel the order.

If the payment has already been made, any refund will be made by the same method used by the customer in the order.

Pursuant to Legislative Decree 70 of 9 April 2003, we inform the Customer that in order to make a purchase offer, he should follow the cart procedure in Italian, which permits to identify and correct any errors in the data entered before entering the order form.

Once the purchase offer has been sent, and immediately after accepting such offer, the Seller will send by email the General Sales Conditions and the "Order Registration Confirmation" (with a summary of the information on the features of the product bought, the details of the price, the method of payment used, the costs of delivery and any other additional costs, as well as, for consumers, the information on the right of withdrawal).

Time of shipment and delivery of the products

Trem Srl will send ready-for-delivery goods within 3-5 working days of receiving the order, and out-of-stock products within the time of delivery indicated in the product sheets.

If the requested products are not in stock at the moment, Trem Srl will notify, within 3-5 days of receiving the order, the expected date of shipment or the unavailability of the products ordered, without incurring any liability in that regard. The time indicated, therefore, will not be considered as binding for Trem Srl.

Trem Srl delivers its products through specialized couriers. Shipping costs are to be paid by the Customer and are clearly indicated in the cart upon the purchase. The shipping costs vary depending on the destination, weight and volume of the goods. Please note: a supplement of Euro 20,00 will apply for difficult-to-access locations, as per the list downloadable at this link.

The Customer may indicate directly in the cart whether s/he wishes to book the delivery and be contacted by the Courier before the delivery. If nobody is there at the moment of the delivery, the courier will leave a paper notice and you should contact them to agree upon the delivery. After a second unsuccessful attempt, the product will be kept at the Carrier’s office, free of charge, for 10 days, after which the order will be automatically cancelled and we will refund the relevant value, less delivery and storage costs.

The product bought is shipped to the Customer at the address indicated upon the purchase, street level; delivery at upper floors or with tail lift in case of heavy packages or personal needs must be specifically requested upon the purchase.

After the shipment, you will receive a confirmation e-mail. Upon receiving the goods, the customer should verify that the packages are intact and correspond to what is indicated in the accompanying document and in the “Order Confirmation email” in terms of quantity and quality

Please note: we may answer for damages caused by transport only if the goods are accepted subject to control, specifying the relevant reasons.

If the package is broken or has been tampered with, the Customer should therefore, in collecting the goods, sign the delivery note “SUBJECT TO CONTROL” (on the copy left to the courier). He may thus verify the contents and inform us on the conditions of the goods. It is also necessary to specify the reason of the qualification (e.g. package broken, crushed, damaged, punctured or torn, apparent damage to the product, etc.).

No claims are acceptable if they are not noted in writing on the delivery documents returned to the courier. All parcels are insured but no coverage is provided without an indication on the delivery note.

Damages must be notified within 7 actual days of receiving the goods, after which nothing can be done. Customers may return defective or damaged goods within the same period of 7 days, by sending an e-mail notice to the address info@ibath.it. Defective goods, if accepted, will be replaced or refunded.

Trem Srl is not liable for delays in the delivery caused by the courier, or for losses or damages occurred after the delivery of the items to the Customer. If the delivery does not take place within 30 days of the date indicated, the Seller is bound to refund the price paid in full.

Prices and payment

The prices disclosed on the site are in Euro and inclusive of VAT.

The Products purchased may be paid according to the payment methods described in the site during the purchase procedure.

In case of withdrawal or termination of the contract, for any reason requiring the amount paid by credit card to be credited back, the supplier will request the release of the amount by the issuer of the card. The time of release is under the exclusive control of the issuer of the credit card or of PayPal.

Trem Srl will hand the goods to the courier only after collecting the sale price, unless other forms of payment have been agreed upon by the same with the Customer.

The goods may be paid using the following methods:

  • CREDIT CARD: accepted cards VISA, Mastercard, American Express, Diners and Maestro, Postepay; payments occur via the secure server of PAYPAL, where you can complete the transaction through an SSL connection.
  • BANK TRANSFER: if this method is selected, the goods will be shipped only after verifying that the amount has been credited on our bank account. You should report in the reason for payment your first name, surname, city and order confirmation number received via e-mail. The amount is usually transferred in 2-3 days. If we do not receive the payment within 4-5 days of the order, the same will be considered invalid and cancelled.

Annulment/cancellation of an order

To cancel an order, please notify us of your decision by phone or e-mail as soon as possible and however within 24 hours of the order. In this case, Ibath will refund the entire amount to the Customer via the same channel used for the payment.

Seller’s warranty

The Seller warrants to the Customer for 2 years after the date of delivery of the products (Decree-Law 24/02), that the products are free from manufacturing and design defects making them unsuitable for their intended use. The 2-year warranty applies to private Consumers, i.e. individual buyers of the products. For customers using the products for professional services (purchase with VAT number) the warranty has a validity of 12 months. To obtain assistance under warranty, the customer must keep the invoice.

The Seller’s warranty excludes improper use, alterations or changes made by the Customer on the products without the consent of the Seller, or failure by the Customer to notify the Seller of the defects or non-conformities of the products by registered letter A/R.

The Seller will be exempt from all liability if:

  • the products have been replaced and/or repaired due to force majeure events, or fault or negligence of the Customer or of the latter’s customers;
  • the products, or part thereof, have been improperly used or stored, by the Customer or by the latter’s customers. Excepting only the cases of willful misconduct or serious negligence of the Seller, the liability of this latter for the products supplied will be limited to the obligation to repair or replace the defective or non-conforming products.

The Seller’s liability for any reason whatsoever will never include indirect, incidental or consequential damages or losses that the Customer may have incurred due to the defects or non-conformities of the products.

The year of guarantee of the replaced product starts from the date of delivery.

Non conformities of products and complaints

If flaws or defects are found in a product, the Customer must put forward the claim via e-mail. Once the Seller has verified and acknowledged the claim, it may, at its option:

  • replace the products with conforming products at no additional cost to the Customer
  • riparare i prodotti senza alcun onere addizionale per il Cliente, oppure
  • repair the products at no additional cost to the Customer, or refund to the Customer the price paid for the non-conforming products and thus rescind the contract in relation thereto. In all events, the Customer must return the product intact and properly packaged, at his own cost.

Right of withdrawal

The right of withdrawal for distance sales does not apply to the supply of tailor-made or clearly customized goods (such as custom-made basins, shower trays, mirrors and others) or products that, by nature, cannot be reshipped, or that are likely to quickly perish or deteriorate, as per Legislative Decree no. 185/99 – art. 5 subsection 3.

A Customer qualifying as Consumer is entitled to withdraw from the contract of purchase of the product without any penalty and without specifying the reasons, within 14 working days of receiving the product under art. 52 and ff., D.Lgs 21 of 21/02/2014. Only individuals may withdraw, not legal persons. Saturdays are considered as holidays. If the time limit ends on a public holiday, it is extended to the next working day.

If a Customer intends to withdraw, s/he should give an express notice by registered letter A/R, via e-mail to the address info@ibath.it, via fax to the number 0434.610781 or through the appropriate form (downloadable pdf). The withdrawal may regard all or part of the products bought. Ibath will send the consumer the file number assigned by e-mail.

The costs to return products are to be entirely borne by the consumer; this applies even when a discount on the shipment was granted when the product was purchased. This means that the consumer is fully responsible for the return. If the product is damaged during transportation, Trem Srl will inform the customer (within 5 days of receiving the product), to enable the same to file a claim against the courier and obtain the refund of the product (where insured). Trem Srl will not answer in any way for damages to or loss of products returned through shipments that have not been insured.

The goods must be returned intact, in their original packaging and complete with all their parts (including packaging, documents and accessories) within 14 days of the date on which the user notified the intent to withdraw under article 54. Please do not use adhesive tape directly on the original packaging of the product.

After verifying the compliance with the above directions, the supplier will refund the price of the products to which the withdrawal refers, including delivery costs paid for initially, within 14 days of receiving the goods, using the same means of payment used by the consumer for the initial transaction, unless agreed otherwise between the parties.

Title retention

All items supplied, even those to be installed and embedded, will remain the property of Trem Srl until the agreed price, interest and costs are paid in full. This right is subject to the provisions of art. 1523 and following of the Italian Civil Code. It will apply even if the payment of the installments is extended or deferred.

Place of jurisdiction

The sale contract between the Customer and Trem Srl will be intended to have been concluded in Italy and is subject to the Italian laws. The Courts of Pordenone will have exclusive jurisdiction over any dispute related to the application, performance and interpretation of this contract. If the Customer acts as a “consumer”, however, the jurisdiction lies with the courts of the place where the customer lives or has chosen his/her domicile.

Privacy and personal data protection

Personal data are collected in order to register the Customer and implement the procedures for the performance of this contract and for the necessary notices related thereto. All data are processed electronically in compliance with the applicable laws and may be disclosed only at the express request of judicial or other authorities allowed to do so under law. Personal data will be disclosed to the persons who are to carry out the necessary activities for the performance of the contract and only for such purpose.

The security and confidentiality of the Customer’s data is a priority for the Supplier; information regarding the person, company/firm and the orders and purchases made is strictly confidential and the supplier shall not disseminate or sell the data in its hands to third companies for marketing purposes.

The information provided will only be used to send newsletters, inform on certain news and promotions, offers of new products, unless a refusal is expressed in that regard upon the registration or afterwards via an email sent to the address info@ibath.it

By signing the information and consent form, the Customer declares that s/he has been given all information required under art. 13, D.Lgs. 196 of 30 June 2003 and gives the consent under art. 23 of the decree to personal and corporate data being processed in accordance with the law and possibly disclosed to third parties (or moved to other Countries within the European Union or third countries in the meaning of art. 42 and 43 of the decree, particularly to foreign persons even outside the EU), whose cooperation is necessary.
